Fresno Woman Charged with Murder in a DUI Hit & Run

On Wednesday morning July 11, 2012, a 26 year old woman from Fresno California was seen driving under the influence in a construction zone on Highway 99. Authorities state she was driving a 2007 Nissan Altima when she hit a 24 year old male construction worker and college grad of Fresno state. He was an employee of Windsor Fuel Co. working on resurfacing the highway when she hit him and was seen fleeing the scene. A few hours later an anonymous caller recognized her car with the description of the wanted fugitive and she was taken into custody.

The intoxicated driver already had one DUI conviction on her criminal record and she is now residing in the Fresno County Jail, facing murder charges for vehicular manslaughter. The California vehicle code 23152 states that it is against the law for any person to operate a motorized vehicle while they are under the influence of alcohol or drugs. The statute of limitations labels intoxication as having a blood alcohol content (BAC) of a .08% or higher.

If someone is suspected of driving under the influence in California, they will be pulled over and asked to perform certain field sobriety tests conducted by law enforcement officials. If they fail the sobriety tests, their license can either be suspended or revoked and the arrest report will then be sent to the California DMV so they can review the results themselves and 90% of the time they will uphold the same verdict. That is why accused drivers only have 10 days after being arrested to schedule a DMV hearing to contest license suspension or revocation or it will stand true.

Convicted drunk drivers may also face jail time, steep fines and attend mandatory alcohol treatment programs.
